Functional Neuro Health ("FNH", "we", "us", "our") respects your privacy and is committed to protecting your personal information. This Privacy Policy explains how we collect, hold, use and disclose your personal information, and how we comply with the Privacy Act 1988 (Cth) ("Privacy Act") and the Australian Privacy Principles ("APPs").

It applies to our website functionalneurohealth.com, our related sites and learning platforms (including our Foundations and Mastery practitioner training on Kajabi, community spaces and booking pages), and to our clinical, educational and marketing activities generally.

By using our website, booking a session, enrolling in a programme, or otherwise providing us with your personal information, you consent to your information being handled as set out in this Policy.

Who we are: Functional Neuro Health is an applied functional-neurology clinic and practitioner-education provider based in Melbourne, Victoria, Australia, founded by Nick Moss. FNH operates under the name Functional Neuro Health 54 913 259 915.

1. The kinds of personal information we collect

Depending on how you interact with us, we may collect:

  • Identity and contact details β€” your name, email address, phone number, postal or business address, and social media handles.
  • Booking and enquiry information β€” details you provide when you book a Neuro Health Assessment or session, submit a contact/enquiry form, or request our free guide.
  • Health and clinical information β€” where you attend our clinic or sessions, information about your health history, symptoms, nervous-system and functional-neurology assessments, goals and progress. This is sensitive information (see section 4).
  • Practitioner and student information β€” where you enrol in FNH Foundations, Mastery (the Neuro Pro Masters Programme) or related training: your professional background and qualifications, modality and registration details, insurance details, payment and enrolment information, course progress, assessments and certification status, and contributions you make in community and live calls.
  • Payment information β€” billing details and payment-plan information. Card payments are processed by our third-party payment providers; we do not store full card numbers ourselves.
  • Marketing preferences β€” whether you have subscribed to our newsletter or guides, and your engagement with our communications.
  • Technical and usage information β€” collected automatically when you use our website and platforms (see section 6), such as your IP address, device and browser type, pages viewed, and referring URLs.
  • Media and testimonials β€” where you provide them, photos, video, recordings or testimonials, subject to a separate media release/consent where applicable.

2. How we collect personal information

We collect personal information in a number of ways, including when you:

  • visit or interact with our website, learning platforms or social media pages;
  • complete a contact, enquiry, booking, or sign-up form (including for our free guide or newsletter);
  • book or attend a session, assessment or event (including via our scheduling tools);
  • enrol in, pay for, or participate in an FNH programme or community;
  • correspond with us by email, phone, messaging or social media; or
  • apply to be listed on, or are referred through, our Practitioner Finder.

Where reasonable and practicable, we collect personal information directly from you. Sometimes we may collect it from third parties β€” for example, our course/community platform, payment processor, scheduling provider, or a person who refers you to us β€” in which case we take reasonable steps to ensure you are aware of this Policy.

3. Why we collect, hold, use and disclose personal information

We collect, hold, use and disclose personal information for purposes including to:

  • provide our clinical services, assessments and care;
  • deliver our education programmes, community, mentoring, assessments and certification;
  • manage bookings, enrolments, payments and your account;
  • respond to your enquiries and provide support;
  • administer the Practitioner Finder and verify practitioner status;
  • send you service-related communications and, where permitted, marketing (see section 5);
  • improve our website, programmes and services;
  • maintain the security and integrity of our platforms and protect our intellectual property;
  • meet our legal, regulatory, insurance and record-keeping obligations.

We will only use or disclose your personal information for the purpose for which it was collected, a directly related purpose you would reasonably expect, a purpose you have consented to, or as otherwise permitted or required by law.

4. Sensitive and health information

Some of the information we collect β€” particularly health and clinical information β€” is sensitive information under the Privacy Act, which attracts higher protections.

We only collect sensitive information where it is reasonably necessary for our functions or activities and:

  • you have consented to its collection; or
  • the collection is otherwise required or authorised by law.

We use and disclose health and sensitive information only for the primary purpose for which it was collected (for example, providing your care or training), for a directly related secondary purpose you would reasonably expect, or with your consent. We handle health information in accordance with applicable privacy and health-records laws in your jurisdiction.

Important: FNH provides education and, where applicable, clinical services. Information you share is handled confidentially in line with this Policy, but please avoid sharing more sensitive detail than necessary through public or community channels.

5. Direct marketing

With your consent (or where otherwise permitted under the Privacy Act and the Spam Act 2003 (Cth)), we may send you marketing communications about our programmes, events, resources and updates β€” for example, our newsletter and free guides.

You can opt out at any time by using the unsubscribe link in our emails or by contacting us (see section 13). We will action opt-out requests promptly. We do not sell your personal information to third parties for their own marketing.

6. Cookies, analytics and our website

Our website and platforms use cookies and similar technologies to help the site function, remember your preferences, and understand how our site and programmes are used. These include the Meta (Facebook) Pixel on our website, Google analytics tools (including Google Search Console), Kajabi's built-in analytics, and student-progress tracking we maintain in Notion.

Most browsers let you refuse or delete cookies; however, some features of our site may not work properly if you do. Third-party analytics and advertising providers may collect information subject to their own privacy policies.

7. Who we disclose personal information to

We may disclose your personal information to:

  • Our team and contractors β€” staff, mentors and contractors who need it to perform their roles (for example, our operations/student-support team), subject to confidentiality obligations.
  • Service providers β€” third parties who help us operate, including:
    • our course, community and coaching-call platform (Kajabi), which also handles our email marketing;
    • our internal operations, financial and governance tracking (Notion);
    • our scheduling/booking provider (OnceHub);
    • our payment processor (Stripe);
    • analytics providers (Meta, Google) and IT/security providers.
  • Professional advisers β€” such as our accountants, insurers and lawyers, where reasonably required.
  • Others with your consent, or where disclosure is required or authorised by law.

We take reasonable steps to ensure our service providers handle your information consistently with the APPs.

8. Overseas disclosure

We train and work with practitioners and clients in a number of countries, and some of our service providers store or process data outside Australia (for example, in the United States or other jurisdictions where our platform and payment providers operate).

Where we disclose personal information overseas, we take reasonable steps to ensure the recipient handles it in a manner consistent with the APPs. By providing your information, you consent to this disclosure. As we have students and clients in the EU and UK, where the EU or UK General Data Protection Regulation (GDPR) applies to you, you may have additional rights β€” including rights to access, rectify, erase, restrict or object to the processing of your personal information, and to data portability β€” and you may lodge a complaint with your local data protection authority.

9. How we hold and protect your information

We hold personal information in electronic systems (including our platforms and the third-party services noted above) and, where relevant, in physical records. We take reasonable steps to protect personal information from misuse, interference and loss, and from unauthorised access, modification or disclosure β€” including access controls, secure platforms, and limiting access to those who need it.

No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

10. Data breaches

We have processes to identify and respond to data breaches. If a data breach is likely to result in serious harm to affected individuals, we will notify those individuals and the Office of the Australian Information Commissioner (OAIC) as required under the Notifiable Data Breaches scheme.

11. Retention

We retain personal information only for as long as necessary for the purposes set out in this Policy, or as required by law (including clinical, financial and insurance record-keeping obligations). When information is no longer needed, we take reasonable steps to securely destroy or de-identify it.

12. Accessing and correcting your information

You may request access to the personal information we hold about you, and ask us to correct it if it is inaccurate, out of date, incomplete, irrelevant or misleading. To make a request, contact us using the details in section 13.

We will respond within a reasonable period. In limited circumstances we may decline a request as permitted by law, in which case we will explain why and how you may complain.

14. Children's privacy

Our services are directed to adults. We do not knowingly collect personal information from children under 18 without the consent of a parent or guardian. If you believe we have collected such information, please contact us and we will take reasonable steps to delete it.

15. Third-party links

Our website and communications may contain links to third-party sites and platforms. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy policies.

16. Your consumer rights

Nothing in this Policy limits any rights you have under the Australian Consumer Law or other applicable laws that cannot lawfully be excluded.
