Functional Neuro Health Practitioner Licensing Agreement
This Practitioner Licensing Agreement (the "Agreement") is entered into between Functional Neuro Health (FNH) ("Licensor") and the individual or entity ("Licensee") accessing and using FNH materials, tools, and methodologies (the "Licensed Material").
Preamble
This Agreement governs the use of Functional Neuro Health (FNH) intellectual property, including proprietary methodologies, tools, and materials (the "FNH Approach"). It also outlines access to course content hosted on the Kajabi platform (the "FNH Institute").
The purpose of this Agreement is to ensure proper use, representation, and attribution of the Licensed Material, while maintaining the professional standards, integrity, and reputation of FNH. By adhering to this Agreement, the Licensee can utilise the FNH Approach confidently and ethically while contributing to its continued growth.
This Agreement reflects our shared commitment to professionalism, collaboration, and excellence within the FNH community.
1. Grant of Licence
The Licensor grants the Licensee a non-exclusive, revocable licence to access and use the Licensed Material, subject to compliance with this Agreement.
1.1 Licence Requirements
- The Licence becomes valid upon successful completion of the FNH Level 1 Theory Exam.
- Until certification, the Licensee must clearly identify their status using titles like "FNH Approach Student" or "@FunctionalNeuroHealth Student" in professional communications.
- Upon passing the exam, the Licensee may refer to themselves as a "Functional Neuro Health Practitioner" and represent their qualification accordingly.
2. Proper Accreditation and Attribution
Accurate attribution ensures the professional integrity of the FNH Approach and reflects your professional status within the FNH community.
2.1 Website and Media Attribution
- Appropriate references to FNH must be included either on your website, social media, or both, as applicable.
- If you do not have a website, it is expected that your certification status is displayed on your social media channels unless you are using an "Impact Statement" to describe your services.
- If you have a website, your certification should be stated as suggested below. There is no expectation for both, but your attribution must appear in at least one of these spaces.
- Recommended formats for attribution:
- Functional Neuro Health Foundations – Functional Neuro Health Institute (Year Completed)
- Neuro Pro Mastery Year 1 – Functional Neuro Health Institute (Year Completed)
- Neuro Pro Mastery Year 2 – Functional Neuro Health Institute (Year Completed)
- Use recommended descriptions:
- "I am a Functional Neuro Health Practitioner."
- "I am a Functional Neurology Practitioner trained in the Functional Neuro Health method."
2.2 Social Media Attribution
- Pre-Certification: Use the title "@FunctionalNeuroHealth Student" in relevant posts to indicate your student status.
- Post-Certification: Tag @FunctionalNeuroHealth when showcasing client outcomes achieved using the FNH Approach. Example:
- "These results were achieved using the Functional Neuro Health Approach."
- Or simply tagging us in your post so we can re-share
3. Intellectual Property Ownership
The Licensed Material remains the exclusive property of the Licensor.
The Licensee agrees to:
- Use FNH methodologies only as authorised under this Agreement.
- Refrain from teaching or sharing the Licensed Material without explicit permission.
- Acknowledge that only Nick Moss or certified FNH educators are authorised to teach the FNH Approach.
4. Proper Use of Materials
To maintain effectiveness and integrity, the Licensed Material must be used as intended.
- Only Nick Moss or FNH-certified educators may provide guidance on the correct application of the FNH Approach.
- Significant deviations from prescribed methodologies that compromise results are not permitted.
5. Professional Standards
The Licensee commits to upholding the highest standards of professionalism, integrity, and respect.
5.1 Integrity and Representation
- Interactions with clients and peers must reflect positively on FNH.
- Misrepresentation of qualifications or outcomes is strictly prohibited.
5.2 Collaboration and Communication
- Open communication with FNH and the community is encouraged to support alignment and growth.
5.3 Consequences of Unprofessional Behaviour
- Behaviour that harms FNH’s reputation may result in review, guidance, or, if necessary, licence suspension.
6. Confidentiality and Non-Disclosure
The Licensee agrees to:
- Treat all Licensed Material, including proprietary methodologies and course content, as confidential.
- Avoid sharing or reproducing Licensed Material without written consent.
7. Breach of Agreement
7.1 Notice of Breach
- The Licensor will provide written notice of any breach, specifying the issue and allowing 14 calendar days for rectification.
7.2 Consequences of Non-Compliance
- Failure to address the breach may result in:
- Suspension or termination of the Licence.
- Revocation of access to FNH resources.
- Further actions to protect FNH’s intellectual property and reputation.
8. Governing Law
This Agreement is governed by and construed in accordance with Australian Copyright Law, including the Copyright Act 1968.
Acknowledgement and Acceptance
By accessing and using the Licensed Material, the Licensee acknowledges and agrees to the terms of this Agreement.
